A Division Bench of the Kerala High Court on Friday made it clear that temporary permits could be allotted to private bus operators for operating super class, superfast, fast passenger, and super express buses on nationalized routes if the KSRTC has not either applied for permits or is not operating any buses despite obtaining permits.

The Bench of Justice Thottathil B. Radhakrishnan and Justice K. Harilal made the ruling while upholding the State government’s new route scheme which exclusively reserved the super-class route services for KSRTC buses.

The court observed that the application of private operator could be considered on notified super-class route if on the date of consideration of the application, the KSRTC had not applied for permit on the route or the KSRTC was not utilizing the permits already given to it.

The court passed the order while disposing of an appeal field by the private bus operators against a single judge verdict upholding the new route scheme of the government.
