A Division Bench of the Kerala High Court has stayed for two weeks the decision of the Kerala Transport Development Finance Corporation (KTDFC) to lease the commercial space of the new bus terminal of the Kerala State Road Transport Corporation (KSRTC) on Mavoor Road here to Mukkom-based company MAK Associates.

The order was passed by Acting Chief Justice Thottathil B. Radhakrishnan and Justice Anu Sivaraman on a petition filed by K.K. Abdulla of Thamarassery. He complained that the KTDFC had unnecessarily intervened for the contractor and that the contract norms remained ambiguous.

They also decided to implead the Chief Secretary in the case.

 The court asked the Additional Advocate General to study the agreement inked between MAK Associates and the KTDFC and submit a report. According to the agreement, the company would pay a monthly rent of Rs.50 lakh in addition to Rs.50 crore as a non-refundable security deposit for the commercial space.

However, the petitioner alleged that such a contract had not been signed and that non-refundable security deposit was not a provision. He also wondered why the KTDFC had not framed the contract. It was also mysterious that the State government issued a notification in the extraordinary gazette on March 23 that the Kerala Lease and Rent Control Act was not applicable to leasing the commercial complex, he alleged.
